Purpose & scope

These general terms and conditions of sale (the “Terms”) govern the contractual relationship between wendows (hereinafter “wendows”) and its customers, for the supply and installation of window frames, solar panels, storage batteries, heat pumps and insulation work. The company’s full details appear in the legal notice.

Any order implies unreserved acceptance of these Terms. They prevail over any document issued by the customer, save for specific conditions expressly accepted in writing by wendows.

Quote & order

Each service is the subject of a free, detailed and dated quote, valid for thirty (30) days from its issue, unless otherwise stated. The quote sets out the nature of the work, the products, the quantities and the price.

The order becomes firm when the customer signs the quote. Any subsequent change is the subject of a written and costed amendment.

Prices & payment

Prices are expressed in euros, all taxes included, at the applicable VAT rate (6% for renovation of homes more than ten years old, subject to conditions; 21% otherwise). Any grants mentioned are given for guidance only and remain subject to acceptance by the regional bodies.

Unless otherwise agreed, a deposit is requested upon ordering, with the balance due on completion of the work; the exact terms appear on the quote. In the event of late payment, late-payment interest may be applied in accordance with Belgian law.

Lead times & performance

The lead times provided are indicative. They may vary depending on supplies, weather conditions and access to the site. wendows informs the customer of any significant delay.

The customer undertakes to keep the site accessible and to provide the connections (water, electricity) needed for the proper performance of the work.

Right of withdrawal

For contracts concluded at a distance or off-premises, the consumer has a withdrawal period of fourteen (14) days from the conclusion of the contract, in accordance with the Belgian Code of Economic Law. To exercise it, the consumer informs wendows of their decision by an unambiguous statement (letter or e-mail) before the period expires.

The right of withdrawal does not apply to goods made to measure, nor to work fully performed before the end of the period with the consumer’s express agreement, the consumer thereby acknowledging that they waive this right.

Warranties

The products and works benefit from the legal warranty of conformity provided for by Belgian law, as well as from the commercial warranties specific to each manufacturer. The durations and conditions of these warranties are set out in the documentation given to the customer.

The warranties do not cover normal wear and tear, nor damage resulting from a lack of maintenance, improper use or the intervention of a third party not appointed by wendows.

Acceptance & complaints

Acceptance of the work is recorded on its completion. Any reservations are set out in writing and resolved within a reasonable time.

Any complaint is sent to wendows in writing (letter or e-mail) as soon as possible, so that it can be dealt with promptly.

Applicable law & disputes

These Terms are governed by Belgian law. In the event of a dispute, the parties shall endeavour to reach an amicable solution before taking any legal action.

Failing agreement, the consumer may refer the matter to the Consumer Mediation Service (mediationconsommateur.be). The competent courts are those of the district of wendows’ registered office.
